Trial has started in a case where the workers are alleging they were made sterile from their exposure to pesticides. The workers were exposed to DBCP which was used to kill worms on the banana plants. The workers claim the employer exceeded the amounts recommended by the producers of the DBCP and were not protected from the unsafe exposure.

The lawsuit accuses Dole Fresh Fruit Co. and Standard Fruit Co., now a part of Dole, of negligence and fraudulent concealment while using the pesticide DBCP in the 1970s. Dow Chemical Co. and Amvac Chemical Corp., manufacturers of the pesticide, "actively suppressed information about DBCP's reproductive toxicity," according to the lawsuit.

Texas Law provides that an employee can hold their employer responsible for injuries and damages they receive due to the unsafe environment created by the employer. If you have been injured as a result of your employer's unsafe business practices please contact an attorney as soon as possible.
