Beth JanicekOctober 08, 2007 10:20 AMTexans for Lawsuit Reform(TLR) is a business group that spends hundreds of thousands of dollars to bash plaintiffs' lawyers and win restrictions on judgments against physicians and other defendants.
A retired orthopedic surgeon, Forney Fleming, was eager to help TLR bash plaintiffs' lawyers especially those who targeted doctors. Dr. Fleming was quoted as saying, "I was practicing in a 'judicial hellhole' and saw the effect of lawsuit abuse, which was decreasing the accessibility of medical care in Jefferson County."
Dr. Fleming did not tell TLR about Texas Medical Board's 2004 reprimand and $7,500 fine for misdiagnosing bone cancer in a 16-year-old girl's leg. Additionally, the board accused Dr. Fleming of providing substandard care to six other patients. The formal complaint is still pending due to his medical license lapsing and his retirement. Dr. Fleming has also been sued or threatened with suits for malpractice on three other occasions. All three cases were settled out of court or resolved through mediation.
His professional problems were not mentioned on the TLR Web site, but his profile was removed last week after TLR's spokeswoman was informed.
His regulatory record is available for public review on the Texas Medical Board's Web page, which TLR hadn't bothered to check.
