Most Disciplinary Actions Against Texas Doctors in History

A news release on August 31, 2006 states:

"Since its last Board meeting in June, the Texas Medical Board has taken disciplinary action against 99 licensed physicians. The largest number of actions taken at any single time in the board's history."

The following doctors in San Antonio were disciplined for the following reasons:

German Benavides, M.D. was disciplined for a quality of care violation. It states Dr. Benavides failed to meet the standard of car in treating patients in 1997 and 1998. Additionally, he failed to maintain an adequate medical record on a patient in 1999.

Clarence Milton Porter, M.D. was disciplined for quality of care violation. It states Dr. Porter failed to meet the standard of care because he did not follow through on abnormal laboratory results by contacting the patient's surgeon directly or sending the patient to the surgeon's office.

Ronald Lynn Bear, M.D. was disciplined for unprofessional conduct violation. It states only that Dr. Bear was suspended from his residency program and later resigned.

Charles Arthur Coltman, M.D. was disciplined for unprofessional conduct violation. It states Dr. Coltman self prescribed various non-narcotic medications without maintaining a medical record.

Emily Arlene Eilers, M.D. was disciplined for unprofessional conduct violation. It states Dr. Eilers failed to report on her 2004 annual registration application that she had been arrested in 2003 for assault and driving while intoxicated and had pled guilty to disorderly conduct in relation to that incident.

Patrick Henry Wilson, M.D. was disciplined for inappropriate conduct involving physician-patient relationship. Texas Medical Board states Dr. Wilson violated the standard of care by performing a breast examination without a documented chaperone present and without having the consent of the patient to perform the examination.

Phillip H. Hare, M.D. was disciplined for inadequate medical records violation. It states Dr. Hare failed to meet the standard of care in treating a patient because of inadequate documentation of her symptoms, the rationale for stopping certain medications and her mental status on discharge.

Douglas Ted Cromack, M.D., Courtney Nicole Lawrence, M.D., and Federico Pasudag Padua, M.D. were given minimal statutory violations.

The Texas Medical Board does not go far enough to discipline physicians who do serious damage

I have been involved in a custody case. Dr. Mark Blotcky was appointed by the court to treat my son. Dr. Blotcky went beyond his court appointed role to diagnose me whom he had never seen as a patient and write reports about me. He also went on to report to the court that I tried to murder my ex-husband yet he never reported the "crime" to the police or CPS. He also billed fraudulently.

I am a physician in Dallas and I have been in practice at Presbyterian Hospital. I have a general medicine prractice and I could hardly be working if I were serverly mentally ill.

I complalined to the board twice about Dr. Blotcky and my claims were rejected after investigation.

This fall I had my attorney submit a complaint to the board and it was rejected as nonjurisdictional.

I am unclear as to how the medical board does not have jurisdiction in this setting.

I have spoken to other lawyers that have filed complaints against experts physicians and had a similar experience.

I have lost all my parental rights as a result of Dr. Blotcky's testimony.

Where is the medical board to discipline such a physician?
