In Robertson County, the families of four victims killed in a construction related car wreck were awarded a multimillion dollar judgment. T.J. Lambrecht Construction, Inc. out of Fort Worth, Young Contractors, Inc. out of Bryan and W.W. Webber, LLC out of Houston were ordered to pay $3,036,800.00. At the time of the car wreck, the companies were involved in construction work on Texas 6 south of College Station. A contractor for the project was turning into the construction site when he stopped in the left southbound lane of the four lane highway. The construction companies failed to take the necessary precautions in providing safe entries and exits to the construction site. The construction vehicle that was stopped on the highway caused the chain reaction car wreck, killing four people.

In Texas, the Texas Department of Transportation (TxDot) develops the road construction plans for the construction companies to follow. TxDot is, for the most part, immune from any liability for the plans they design. If the construction company follows these plans then they too are likely to escape any liability for an improperly designed construction plan. In the cases I have handled, it has been my experience that the construction company does not follow the plan developed by the TxDot engineers and as a result of their deviation from the plans, a car wreck occurs and liability attaches to the construction company.
